¥ Fluoride Toothpastes-the FDA is seeking data on non-animal testing methods.
¥ MoCRA Update:
a. Fragrance Allergens Notice of Proposed RulemakingÐ FDA is looking to announce these in
November of this year.
b. The FDA is looking to ban Formaldehyde and Formaldehyde Releasing Agents in hair smoothing
and straightening products-New Proposed date in November 2026.
c. GMPs and Test Methods to Identify Talc- New Proposed Date in Nov. 2027.
California
¥ SCP:
a. TPhP listed as priority product at conc. Greater than 250 PPM effective Oct. 1, 2026.
Manufacturers exceeding the quantity must submit a Priority Product Notification by Nov. 30, 2026.
By March 30, 2027, manufacturers must submit a Intent/Confirmation Notification for Product
Removal or an Intent/Confirmation Notification for Product-Chemical Replacement or a
Preliminary Alternative Analysis Report or one of the other reporting options.
¥ OEHHA:
a. Released draft amendments for Prop 65, which included clarifications for how and when
warnings are required and how the natural exemption is applied. Comment period open till Sept.
7, 2026
b. OEHHA added Hydrochlorothiazide, Voriconazole, and Tacrolimus to the Prop 65 list on July 17,
2026.
c. Proposed change to DEA (dermal) NSRL listing. 15 day comment period started on June 10, 2026.
d. Public Comment Period of Draft Cancer Inhalation Unit Risk Factor of Acrolein and Ethylene
Oxide was open till June 29, 2026.
e. Notice of intent to List Hydrochlorothiazide, Voriconazole, Welding Fumes, and TacrolimusComment period was open till June 8, 2026.
¥ SB-54-Coalition has requested legislative action to address affordability concerns that have
been raised due to the pending implementation of SB 54
¥ SB 343-a federal judge has issued a preliminary injunction, which temporarily blocks the
enforcement of SB 343.
¥ California Safe Cosmetics Program (CSCP)- Reportable Ingredient list was updated including
reporting requirements for 56 new fragrance allergens for CFFIRKA, deadline for products currently
on the marketplace before July 31, 2026 must be report by July 31, 2028. Or products introduced
after k=July 31, 2026 must be reported within the standard timeline of the regulation.
